Higher and Further Education and Research Councils in the United Kingdom, and to Universities and Colleges of Further Education in the Republic of Ireland.

Other organisations aligned with Eduserv’s charitable objectives of supporting education, research bodies and the public sector may ask to participate in the Agreement. Eduserv will liaise with the Supplier about any such requests.

Copying of hardcopy and electronic documentation is permitted for staff and registered students and other permitted users except Alumni. Registered users are able to make up to make up to 25 copies of the resources.

Alumni specifically:
Where additional access has been subscribed to for Alumni (who have access to subscribing library’s facilities) they may copy parts of both hardcopy and electronic for personal use only and may not distribute it without requesting permission through either Rightslink or emailing permissions@emeraldinsight.com.

Terms and Conditions

The Chest Order, together with the Licence Terms and Conditions, and any exceptions listed below, create a legally binding contract between your institution, organisation or company and the Licensor. Therefore please read the terms and conditions carefully and only submit a Chest Order if its terms and conditions are acceptable to your institution, organisation or company and you have the authority to make the financial commitment shown.

Licence

This Site licence is subject to the terms and conditions for the Standard Chest Licence for Online Resources with amendments shown at the bottom of this screen.

Licensees may purchase an Educational Purposes Licence Extension (See Annex A of the Licence) or an Alumni Licence Extension (See Licence Definition 1.1(a)(iv) and Annex A).

Alumni use is only permitted if the Alumni Licence Extension is chosen.

Annual opt-opt/early termination is not permitted for Institutions in Jisc Bands 8-10 who have chosen to be "locked-in" until 31 December 2020. Other Institutions must give written notice to terminate early - see the Exceptions to the Terms and Conditions below.

What can authorised users do?

The resources can be used for Educational Purposes – defined as:

  • education
  • teaching
  • distance learning
  • private study
  • academic research
  • administration and management of the Licensee’s educational or research operations

Exclusions:

  • The resources may not be used for anything other than Educational Purposes unless the Licence Extension for Commercial Projects has been bought; this allows use for the restricted “Commercial Projects” defined – see Annex B of the Licence (Licence Extension for Commercial Projects)
  • Downloading of large amounts of material by authorised users that might be considered ‘systematic’.

Termination Clauses

The Licensee may retain an electronic copy of the Licensed Material in its archives for reference only. Copies of parts of the Licensed Material already made and/or used by the Licensee or Authorised Users in accordance with clause 2.2 may be retained and used in accordance with the terms of this Licence Agreement – see Licence Term 10.5.

The Licensee retains the right to the material published in the year in which they subscribed. This will continue to be accessed from the Emerald platform and no access fee applies.

Licensees may opt out of the agreement annually by giving notice not later than 1st October preceding the next subscription year. i.e. 1 October 2018 for a subscription commencing 1 January 2019 or 1 October 2019 for a subscription commencing 1 January 2020.

Personal Licences

Personal licences are not available.

Exceptions to the Terms and Conditions

Two additional sentences are appended to Term 1.1(a)(iv) of the Terms and Conditions for the Standard Chest Licence for Online Resources: “Alumni members may additionally access the Licensed Material remotely from other than the premises of the Licensee. Where additional access has been subscribed to for Alumni, Alumni may copy parts of both hardcopy and electronic documentation for personal use only and may not distribute it without requesting permission through either Rightslink or emailing permissions@emeraldinsight.com.

Clause 10.4 of the Terms and Conditions for the Standard Chest Licence for Online Resources is amended so that “ninety” rather than “sixty” days’ prior written notice of termination must be submitted.

The Fee for early termination in accordance with clause 10.4 of the Terms and Conditions for the Standard Chest Licence for Online Resources is nil.

The Fee for retention rights upon termination in accordance with clause 10.5 of the Terms and Conditions for the Standard Chest Licence for Online Resources is nil.

Currency: All prices are in GBP and exclude VAT 

Institutions can pick 3, 6 or 9 collections from the nine Management and four Specialist collections, or choose the Premier Collection consisting of all 13 collections as described on the Product Information tab.

If you choose the Pick 3, 6 or 9 options please advise Chest Help which collection(s) you would like.

Additional collections can be added to 3, 6 or 9 picks for an additional fee(s) as set out in the pricing table below. Please advise Chest Help which collection(s) you would like to add.

Licence Extensions:

Educational Purposes Licence and Alumni Licence Extensions can be added to Site Licence Annual Fees as shown in the table below. Please contact Chest Help when you order your licence to add these extensions.

FTE refers to the number of additional FTEs being licensed under the Educational Purpose Licence.

eJournal Collections for HE

All HE Institutions will pay the  prices below, with the exception of institutions in JISC bands 8-10 who, if they opt to "lock-in" for the entire 3 year agreement period, will pay 20% less. Institutions that choose this option are not eligible to the additional discounts on other Emerald Resources.

Payment Terms

On receipt of a completed Order Form Institutions will be invoiced for the Agreement year in which the Licence is signed.

In subsequent years, Institutions will be invoiced three months in advance of the anniversary date of the Agreement, on 1 October 2018 and 2019.

There is monthly pro-rata charging for institutions which become licensed partway through a licence year.

Chest is an Enterprise of Jisc. All Purchase orders must be made out to JISC, One Castlepark, Tower Hill, Bristol, BS2 0JA

Payments are due within thirty days of invoice date; recipients of late payments are entitled to interest in accordance with UK statutory provisions.
