Eligible Institutions

Universities, colleges and other learning, educational and research bodies in the UK and Republic of Ireland.

Other organisations aligned with JISC’s charitable objectives of supporting education, research bodies and the public sector may ask to participate in the Agreement. JISC will liaise with the Supplier about any such requests.

Where additional access has been subscribed to for Alumni (who have access to subscribing library’s facilities) they may copy parts of both hardcopy and electronic for personal use only and may not distribute it without requesting permission through either Rightslink or emailing permissions@emeraldinsight.com.

Terms and Conditions

The Chest Order, together with the Licence Terms and Conditions, and any exceptions listed below, create a legally binding contract between your institution, organisation or company and the Licensor. Therefore please read the terms and conditions carefully and only submit a Chest Order if its terms and conditions are acceptable to your institution, organisation or company and you have the authority to make the financial commitment shown.

Additional use by Alumni is allowed where the licensor has subscribed to additional  alumni access.

All terms contained in a PO are expressly rejected and do not form part of the Licence or vary the Licence terms in any way.

What can authorised users do?

The resources can be used for Educational Purposes – defined as:

  • education
  • teaching
  • distance learning
  • private study
  • academic research
  • administration and management of the Licensee’s educational or research operations

Exclusions: [Delete or amend as appropriate]

  • See the Licence for any exclusions and restrictions
  • The resources may not be used for anything other than Educational Purposes unless the Licence Extension for Commercial Projects has been bought; this allows use for the restricted “Commercial Projects” defined – see Annex B of the Licence (Licence Extension for Commercial Projects)
  • Downloading of large amounts of material by authorised users that might be considered ‘systematic’.

Termination Clauses

The Licensee may retain an electronic copy of the Licensed Material in its archives for reference only. Copies of parts of the Licensed Material already made and/or used by the Licensee or Authorised Users in accordance with clause 2.2 may be retained and used in accordance with the terms of this Licence Agreement – see Licence Term 10.5.

The Fee for early termination in accordance with clause 10.4 of the Terms and Conditions for the Standard Chest Licence for Online Resources is nil.

The Fee for retention rights upon termination in accordance with clause 10.5 of the Terms and Conditions for the Standard Chest Licence for Online Resources is nil.

Personal Licences

Personal licences are not available.

Exceptions to the Terms and Conditions

  1. Definition 1.1(a)(i) (Authorised Users) is amended. This final sentence is removed: “Visiting students and researchers are classed as “Students” whether or not they are reported or registered or enrolled by the Licensee. Students may access the Licensed Material on-site or off-site.”
  2. Definition 1.1(a)(iv) (Authorised Users) is amended: “Alumni members, which means a Walk-in user…” is changed to “Alumni members, which means a user…”
  3. The following additional Definitions are added:
    • “Eligible Author” means a corresponding author that has submitted a journal article manuscript for publication with the Licensor, in a journal that is within the Licensed Materials at the date of submission and has stated its affiliation with the Licensor at submission.
    • “Institutional System” means a system, such as an institutional repository or current research information system (CRIS), which an Institution uses to collect, store or make publicly available, research outputs including information relating to research outputs.
    • “Publication Events” means the publication of the version of record of article manuscripts accepted for publication by the Supplier where the corresponding author is an Eligible Author.
    • “Router Data” means the author accepted manuscripts associated with the Publication Events with a JATS compliant XML file and any other associated information or data sent by the Supplier to the Jisc Publications Router.
    • “Router Feed Start Date” means a date from which the Licensor’s feed to the JISC Router will start, which the parties anticipate will be no later than 31 March
  4. Clause 5.1(c) is amended. The following wording is deleted: “or false or misleading or offensive or pornographic or obscene or derogatory or discriminatory or racist or defamatory or inflammatory;”
  5. Clause 5.1 (h) is amended. The following wording is deleted: “it will make updates and new versions available in accordance with the descriptions and frequencies shown in the Specification.”
  6. An entire new clause is added and numbered as clause 6. Subsequent clauses have been renumbered. The text of this new clause is:

6. Open Access

6.1 Throughout the Term, Authors affiliated with the Licensee may, from the date of publication, deposit the version of the article that has been accepted for publication (the Author Accepted Manuscript (AAM)) by the Licensor on the following conditions:

      1. For non-commercial scholarly purposes only
      2. With individuals requesting personal use
      3. For teaching and training within the author’s institution, as part of an author’s grant applications or these/doctorate submissions
      4. Under the Creative Commons Attribution Non-commercial International Licence 4.0 (CC BY-NC 4.0) (available at https://creativecommons.org/licenses/by-nc/4.0/)
      5. Subject to full attribution
      6. Deposits are limited to the following locations:
        1. Author's personal website
        2. Author's company or institutional repository
        3. Subject repositories; and
        4. Social Collaboration Networks (SCNs) that have signed up to the Voluntary STM Sharing Principles (available at https://www.stm-assoc.org/stm-consultations/scn-consultation-2015/)
      7. The deposit into the repository of another institution is not permitted
      8. The systematic upload or collation of the Licensor’s articles across repositories is not permitted.

6.2 Authors affiliated with the Licensee may post the version of the article that was submitted to the journal (pre-print) to the above resources, at any time.

6.3 From the Router Feed Start date, the Licensor shall  permit and facilitate the deposit of manuscripts by Eligible Authors that are accepted for publication in the Licensed Material in Institutional Systems and approved repositories via Jisc Router under licence terms that comply with the UKRI requirements, which are anticipated to be zero embargo, CC-BY licence.

6.4 The Licensee permits the Licensor to deliver Router Data to the Jisc Publications Router in accordance with the terms of the agreement between the Licensor and Jisc.

6.5 The Licensee acknowledges that the Licensor is not responsible for the publication choices of authors affiliated to the Licensee and the permissions granted in this License are not conditions of publication with the Licensor. 

    1. Clause 10.2 (renumbered as 11.2) is amended. The following wording is deleted: “The Licensor will reasonably endeavour to give the Licensee at least ninety days’ notice, and in any event as much notice as it reasonably can, where it does not intend to offer renewal of this Licence Agreement on broadly similar terms and prices.”
    2. Clause 10.4 (renumbered as 11.4). The notice period and procedure for early cancelation is changed. This clause now reads: “By giving the Licensor written notice before 1 October in any year, the Licensee may terminate this Licence Agreement without cause effective on the following anniversary of the commencement date set out in clause 10.1 except where the Specification and/or Website states that early termination is not permitted.”
    3. Clause 10.5 (renumbered as 5). The right to retain copies of content after termination of the licence is removed. The licence is now silent on this matter.
    4. Clause 14.1 (renumbered as 15.1). The following wording is deleted: “and also to alterations or additions to the Specification.”
    5. Annex B: Licence Extension for Commercial Projects, is deleted.
