The Academy’s scientific body, the Curatorium, calls upon the foremost specialists, including academics, practitioners, diplomats, and other leading experts from all over the world, to deliver courses to an international audience in English or French. The courses are published in the Collected Courses of the Hague Academy of International Law, which is the most important encyclopaedic publication on private and public international law.

This Agreement is of 3 years duration. Institutions may join the agreement at any time during the agreement period. Institutions with subscriptions will then be committed to the end of the Agreement.

Eligible Institutions

Universities, colleges and other learning, educational and research bodies in the UK and Republic of Ireland.

Other organisations aligned with JISC’s charitable objectives of supporting education, research bodies and the public sector may ask to participate in the Agreement. JISC will liaise with the Supplier about any such requests.

Product Description

Founded in 1923, the Hague Academy of International Law has for decades served as a global centre for research about and teaching of public and private international law.

Each summer the Academy organizes in its building located on the premises of the Peace Palace a six-week course at which well-recognized international law scholars present lectures and seminars in French and English on a wide range of current topics to young lawyers from throughout the world. These lectures are then published in the Academy’s prestigious Collected Courses.

The Academy also conducts a three-week summer Centre for Research aimed at in-depth research by younger academics on a selected contemporary issue under the direction of two senior scholars. In addition, the Academy has since the 1960s held courses in Africa, Latin America and Asia with a view to promoting worldwide knowledge of international law and its developments and contributing to the establishment of peace.

These courses are published by Brill.

Online edition is fully searchable and bilingual , French and English, (courses are published in either French or English, depending on the language in which they were given).

Copying of hardcopy and electronic documentation is permitted. A user may:

  • print a copy or download and save individual chapters, articles or other single items of the Products for personal use
  • distribute a copy of individual chapters, articles or other single items of the Products in print or electronic form to other Users or to other individual scholars collaborating with Users but only for the purposes of research and private study. For the avoidance of doubt, this Sub-clause shall include the distribution of a copy for teaching purposes to each individual student User in a class at the Licensee’s Site
  • download a copy of individual chapters, articles or other single items of the Products and share the same with Users or other individual scholars collaborating in a specific research project with such Users provided that it is held and accessible within a closed network that is not accessible to any person not directly involved in such collaboration and provided that it is deleted from such network immediately upon completion of the collaboration.

Terms and Conditions

The Chest Order, together with the Licence Terms and Conditions, and any exceptions listed below, create a legally binding contract between your institution, organisation or company and the Licensor. Therefore please read the terms and conditions carefully and only submit a Chest Order if its terms and conditions are acceptable to your institution, organisation or company and you have the authority to make the financial commitment shown.

Licence

This Site licence is subject to the terms and conditions for the Standard Chest Licence for Online Resources with the exceptions listed at the bottom of the page.

  • The Fee for early termination in accordance with clause 10.4 of the Terms and Conditions for the Standard Chest Licence for Online Resources is nil. Please note that this clause has been amended. The notice period under this agreement is ninety days, not sixty.
  • The Fee for retention rights upon termination in accordance with clause 10.5 of the Terms and Conditions for the Standard Chest Licence for Online Resources is nil.
  • Alumni walk-in use is allowed under the standard licence and is included in the Fee.

Payment Terms

For subscriptions:

On receipt of a completed Order, Institutions will be invoiced for the Agreement year in which the Licence is signed.

In subsequent years, Institutions will be invoiced three months in advance of the anniversary date of the Agreement, on 1 October.

There is monthly pro-rata charging for Institutions which become licensed partway through a licence year.

For One-Off Purchases:

On receipt of a completed Order, Institutions will be invoiced for the Agreement year in which the Licence is signed.

There is no monthly pro-rata charging for Institutions which become licensed partway through a licence year.

What can authorised users do?

The resources can be used for Educational Purposes – defined as:

  • education
  • teaching
  • distance learning
  • private study
  • academic research
  • administration and management of the Licensee’s educational or research operations

Exclusions:

  • See the Licence for any exclusions and restrictions
  • The resources may not be used for anything other than Educational Purposes unless the Licence Extension for Commercial Projects has been bought; this allows use for the restricted “Commercial Projects” defined – see Annex B of the Licence (Licence Extension for Commercial Projects)
  • Downloading of large amounts of material by authorised users that might be considered ‘systematic’.

Termination Clauses

Material downloaded under the Agreement before its expiry may continue to be used under the same licence conditions as pertain while the Agreement exists. Once the Agreement has terminated then no further access to the service and to future publications will be possible unless the Agreement is renewed or extended. If the Agreement is renewed or extended then new conditions will apply. If the Agreement is not renewed then renewal is a matter between Institutions and Brill.

Personal Licences

Personal licences are not available.

 

Exceptions to the Terms and Conditions

Clause 2.2(m) of the Terms and Conditions for the Standard Chest Licence for Online Resources is amended to restrict Interlibrary loan to the UK and by post only, by the insertion of the words “in the UK” between the phrases “another library” and “by post”.

Payment terms

Perpetual (outright) purchase

The purchase price covers the content up to 31 December in the year of acquisition. The Annual Instalment Fee covers the outright purchase of all materials published in subsequent years and retains the right to access and is payable from 1 January following year of purchase.

On receipt of a completed Order Institutions will be invoiced for the Agreement year in which the Licence is signed.

There is no pro-rata charging for outright purchases or instalments for Institutions which become licensed partway through a licence year.

Annual Instalment fee

Fees are charged from year 2 onwards.
Example: if a library takes an outright purchase in 2016, the first instalment fee will be charged in 2017.

Annual subscription

The annual Subscription Fee covers a subscription from 1 January 2016 until 31 December 2018, at the fees per annum stated above, and includes access to all materials published until 31 December 2018. Thereafter, unless a further Licence is obtained from the Supplier commencing 1 January 2019, then access to the Product will cease on 31 December 2018.
